These Terms and Conditions (“Terms”) govern your access to and use of the Héritiers de l’Heure website, products, and services. By browsing our website, placing an order, or purchasing from us, you agree to be bound by these Terms.

 

If you do not agree, please refrain from using our website or services.

1. About Héritiers de l’Heure

Héritiers de l’Heure (“we”, “us”, “our”) is a South African heritage luxury brand creating bespoke, limited, and artistic pieces across jewellery and artwear.

 

2. Eligibility

​

By placing an order, you confirm that:

  • You are at least 18 years of age

  • You have the legal capacity to enter into a binding agreement

  • All information provided by you is accurate and complete

 

3. Nature of Our Products

​

  • Many of our items are bespoke, made-to-order, personalised, limited-edition, or artisanal.

  • Natural variations in materials, stones, metals, textures, finishes, and colour are inherent to the nature of our work and do not constitute defects.

  • Product images are for editorial and illustrative purposes and may differ slightly from the final item.

 

4. Pricing & Payment

  • All prices are listed in South African Rand (ZAR) unless otherwise stated.

  • Prices are subject to change without notice.

  • Full payment is required before production or dispatch.

  • Payments are processed securely via third-party payment gateways. Héritiers de l’Heure does not store card or banking details.

 

5. Orders & Acceptance

​

  • An order is only accepted once payment has cleared and order confirmation has been issued.

  • We reserve the right to cancel or refuse any order where:

    • Payment fails or is reversed

    • An error in pricing or product description occurs

    • Fraud, misuse, or misrepresentation is suspected

 

Where an order is cancelled by us after payment, a full refund will be issued.

 

6. Production & Lead Times

​

  • Bespoke and limited items require production time, which will be communicated at purchase.

  • Lead times are estimates and may vary due to craftsmanship, sourcing, or logistical constraints.

  • Delays do not constitute grounds for cancellation except where required by law.

 

7. Shipping & Delivery

​

  • Orders are delivered via trusted courier partners locally and internationally.

  • Delivery times are estimates and are not guaranteed.

  • Risk passes to the customer upon delivery.

  • Customers are responsible for providing accurate delivery information.

 

For international orders, customs duties, taxes, and clearance fees are the responsibility of the customer.

 

8. Returns, Refunds & Exchanges

Héritiers de l’Heure does not offer refunds or returns.
All sales are final.

An exchange will be offered only where an item is defective, as contemplated under the Consumer Protection Act, 2008.

  • Defective items must be reported within a reasonable period after delivery.

  • All items may be inspected prior to approval of an exchange.

  • Exchanges are subject to availability.

  • Where an identical replacement is not available, Héritiers de l’Heure may, at its discretion, repair the item or offer a suitable alternative in compliance with the CPA.

 

No exchanges will be granted for:

  • Change of mind

  • Size preference

  • Aesthetic preference

  • Normal wear and tear

  • Natural material variation

 

9. Intellectual Property

​

All designs, concepts, imagery, text, branding, and creative content associated with Héritiers de l’Heure are protected by intellectual property laws.

No content may be copied, reproduced, distributed, or exploited without prior written consent.

10. Use of Website

​

You agree not to:

  • Use the website for unlawful purposes

  • Interfere with security or functionality

  • Misrepresent identity or intent

 

We reserve the right to suspend or terminate access where misuse occurs.

 

11. Privacy & Data Protection

​

Personal information is collected and processed in accordance with our Privacy Policy and the Protection of Personal Information Act, 2013 (POPIA).

 

12. Limitation of Liability

​

To the extent permitted by law:

  • Héritiers de l’Heure shall not be liable for indirect, incidental, or consequential damages

  • Liability is limited to the value of the product purchased

 

Nothing in these Terms limits rights that cannot be excluded under South African law.

13. Force Majeure

​

We are not liable for delays or failure caused by events beyond our reasonable control, including natural disasters, strikes, supply interruptions, or courier disruptions.

14. Governing Law

​

These Terms are governed by the laws of the Republic of South Africa.
Any disputes shall be subject to the exclusive jurisdiction of South African courts.

 

15. Amendments

​

We reserve the right to update these Terms at any time. Continued use of the website constitutes acceptance of the updated Terms.
